FAQs

Form E is a form used by company to declare employees status and their salary details to LHDN.

  • Berhad, Sdn Bhd and LLP are required to declare Form E
  • For sole proprietorship and partnership, they need to declare Form E only if they hav employees

Starting from 2016, all Malaysian companies (Sdn Bhd) will need to declare a Form E to LHDN regardless there are employees or not.

Under Income Tax Act 1967 Section 112 or 120, fail to declare Form E are liable to a maximum fine of RM20k or to imprisonment for a term not exceeding 6 months or both.

Recently, Form E can be declared through e-filling, you will not receive Form E by postal anymore. You will need to check your account status by visiting LHDN branches.

March 31st (Before April 30th for e-filling)

Starting from 2016, employers need to include all their employees in Form E regardless income.
Employers need to include ALL employees (including full / part time workers, contract workers and interns) in Form E.
Companies (such as Sdn. Bhd.) and Labuan Companies can only declare Form E through e-Filling. Others (such as Enterprise) can declare through postal but the form must be Malay version.
